THE POSITION

FanDuel is looking for an experienced tax attorney to join our Tax Team in our New York City office. Reporting directly to the SVP of Tax with a dotted line to the Counsel Senior Director within the Legal & Compliance organization, this role will lead the legal function within the Tax team and serve as a key member of both the Tax and extended Legal & Compliance leadership teams. The Counsel Director, Tax will lead all tax controversy matters and support a broad range of tax planning initiatives including managing relationships with external tax and legal advisors, conducting and reviewing tax research and position memos, and interpreting tax statutes and guidance across all tax types - including gaming taxes and customer tax reporting & withholding. This person will collaborate with the Finance leadership team on intercompany agreements, third-party contracts, and regulatory licensing and registration matters and help manage the broader Tax function alongside the SVP of Tax and Tax Director.

This is a unique opportunity to help shape FanDuel’s tax strategy and processes across North America while influencing the broader industry in a dynamic, fast-paced environment.

THE GAME PLAN
Everyone on our team has a part to play

  • Assist the SVP of Tax and Tax Director with managing the Tax function as a whole as a member of the Tax leadership team
  • Serve as a member of the extended Legal & Compliance organization leadership team
  • Develop and deploy future vision for the Tax Legal division including development of a structured tax research and memo drafting upskilling program for the other members of the Tax team
  • Provide sound data-driven business and legal analyses especially when dealing with uncertain areas of tax and gaming law and incomplete data to enable strategic decision-making by senior leadership
  • Own all tax controversy matters under the direct supervision of and with support from the SVP of Tax and Counsel Senior Director
  • Contribute to a wide variety of tax planning projects (e.g., restructuring, M&A, SOX compliance, etc.) across all lines of business within our North American operating groups
  • Interpret current and pending tax and gaming statutes, regulations, and other guidance and collaborate with internal and external stakeholders to develop appropriate action plans based on those interpretations
  • Advise on the potential impacts of pending tax statutory and regulatory changes across all tax types
  • Obtain and maintain a strong knowledge of all lines of business and associated products in order to provide advice regarding any necessary tax related product functionalities and reporting
  • Lead the rest of the Tax team and external tax and legal advisors on conducting/reviewing tax research across all tax types
  • Work with other members of the Tax team and external tax and legal advisor to draft tax and legal position memos across all tax types
  • Assist SVP of Tax and other senior leaders who serve as key SMEs for the Government Affairs and Strategic Partnerships functions
  • Draft/review intercompany agreements and finance-related third-party contract language
  • Partner with the Legal & Compliance organization to help manage all finance-related corporate governance, regulatory licensing, and business registration related matters
  • Liaise with international, federal, state, and local taxing authorities and regulatory bodies
  • Develop and manage relationships with the other internal business functions as needed especially across the Legal & Compliance organization
  • Support the SVP of Tax and Tax Director with managing the other members of the Tax team
  • Manage external tax and legal advisors and related consulting projects
  • Work closely with the international Tax team at Flutter Entertainment plc

THE STATS
What we're looking for in our next teammate

  • Juris Doctorate Degree from a top tier law school and member of at least one state bar
  • Relevant Postgraduate Degree strongly preferred (MS in Taxation, LL.M. in Taxation, etc.)
  • 8+ years of professional tax legal experience practicing as a tax attorney, working as a tax advisor at a public accounting firm, and/or performing an in-house corporate tax advisory role
  • CPA certification a major plus
  • Advanced tax research and tax technical writing skills are required
  • Experience with statutory and regulatory interpretation and analysis is required
  • Experience with contract drafting and review is strongly preferred
  • Experience tracking tax statutory and regulatory changes and advising government affairs functions/advisors on tax related lobbying efforts is preferred
  • Must have a strong desire to learn about new areas of tax law and the gaming regulatory environment (via direction from the FanDuel Group Tax Department and continuing legal education courses)   
  • Must be a self-starter with the ability to work independently and collaboratively in a fast-paced and rapidly growing environment
  • Must be data driven with the ability to bring strong analytical rigor to decision-making with a focus on getting the right answer
  • Excellent organizational skills and time/project management skills are required
  • Excellent verbal and written communication skills are required
    • Experience and comfort with presenting to senior-level executives is a major plus
  • Experience directly managing junior staff members is a plus
  • Professional experience with the sports, gaming, and/or technology industries is a major plus
  • Professional experience with the media and entertainment industry is a plus

The applicable salary range for this position is $180,000 - $250,000 USD, which is dependent on a variety of factors including relevant experience, location, business needs and market demand. This role may offer the following benefits: medical, vision, and dental insurance; life insurance; disability insurance; a 401(k) matching program; among other employee benefits. This role may also be eligible for short-term or long-term incentive compensation, including, but not limited to, cash bonuses and stock program participation.
